WORKMENS COMPENSATION ? PRESUMPTION ? COURTS. 1. Workmens compensation ? Evidence showed disability due to accident. In proceeding for workmens compensation benefits brought by 70-year-old employee who had been very active and who had been performing heavy manual labor before he sustained a leg injury which gave him constant pain and prevented him from engaging in any heavy work, evidence established that employees disability was due to effects of accident and its aggravation and acceleration of arthritic condition. 2. Workmens compensation ? Presumption. Every presumption is in favor of the correctness of decision of Industrial Accident Board and sustaining decision of district court. 3. Workmens compensation ? Duty of Supreme Court. Duty of Supreme Court in a workmens compensation case is to determine whether there is any substantial evidence in record to justify conclusions of district court. 4. Workmens compensation ? Pre-existing disease and disability. An employer takes an employee as he finds him and fact that an employee is suffering from or afflicted with a pre-existing disease or disability does not preclude compensation if disease or disability is lit up, aggravated or accelerated by an industrial accident.
